What is an Anticipatory Bail?
On the basis of Indian criminal law, there is a provision of anticipatory bail under section 438 of criminal procedure code “This provision allows a person to seek bail in anticipation of an arrest on accusation of having committed a non-bailable offense. When a party files anticipatory bail, the court notifies about that bail application to the opposition party. It can be said like that Anticipatory bail is a direction to release a person on bail, issued even before the person is arrested.
When an Anticipatory bail can be apprehending?
If a person feels that there is a move to get him arrested on false background or due to enmity with someone or he thinks that a false case is likely to be built up against him, he has the right to move the session court or high court under the section of 438 of criminal procedure to grant the bail in the event of his arrest. If the court thinks fine, in the event of such arrest he shall be released on bail.
There are some conditions to have an anticipatory bail?
- A condition when the person makes himself available for interrogation by the police officer.
- A condition that the person shall not induce threat to any person with the facts of the case in the series to discourage him about disclosing facts to anyone.
- A condition that the person shall not leave country or state without court permission.
